Welcome to Who's Brew. By using our website and services, you agree to the following Terms & Conditions. Please read them carefully before placing an order or using our platform.

Who's Brew operates as a marketplace platform connecting buyers with independent coffee vendors ("Providers"). Each Provider is responsible for their own products, fulfillment, and customer service.

By accessing or using this site, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree, please do not use the site.

Return & Refund Policy

Each Provider on Who's Brew sets and manages their own return and refund policy. Returns and refunds are handled directly between the customer and the Provider.

If a customer is unable to resolve a return or refund issue with the Provider within 7 business days, Who's Brew may step in to mediate. However, Who's Brew is not obligated to issue refunds on behalf of any Provider.

Customers are encouraged to review each Provider's return policy before making a purchase.

Shipping Policy

Shipping is managed by each individual Provider. Who's Brew does not directly ship products. Shipping costs, delivery times, and methods may vary by Provider and are displayed at checkout.

Customers should contact the Provider directly with any shipping inquiries or delivery issues.

Privacy

Your use of this site is also governed by our Privacy Policy, which describes how we collect and handle your personal data.

Disclaimers

  • Product Liability: Who's Brew is not the manufacturer or direct seller of products listed on the platform. Providers are solely responsible for product quality, safety, and compliance with applicable laws.
  • Allergens: Products listed may contain allergens. Customers should review product descriptions and contact the Provider directly with any allergy-related questions.
  • Listing Accuracy: While we strive to ensure all product listings are accurate, Who's Brew does not guarantee the accuracy, completeness, or reliability of any product information provided by Providers.
  • Damaged or Missing Goods: Any claims regarding damaged, defective, or missing goods must be directed to the Provider. Who's Brew may assist in the dispute process but is not liable for product conditions upon delivery.
  • Certifications: Any claims made by a Provider regarding organic, fair-trade, or other certifications are the sole responsibility of the Provider. Who's Brew does not independently verify such claims.

Limitation of Liability

To the fullest extent permitted by law, Who's Brew shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of this platform, including but not limited to loss of profits, data, or goodwill.

Indemnification

You agree to indemnify and hold harmless Who's Brew, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the platform or violation of these Terms.

Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Florida.

Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms & Conditions or the breach, termination, enforcement, or interpretation thereof, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

The arbitration shall take place in the State of Florida, and the arbitrator's decision shall be final and binding. Judgment on the award may be entered in any court having jurisdiction. Nothing in this section shall prevent either party from seeking injunctive or equitable relief in court for matters related to data security, intellectual property, or unauthorized access to the platform.

Credit Risk & Chargebacks

Who's Brew and its payment partners reserve the right to hold, delay, or reverse payments in the event of suspected fraud, excessive chargebacks, or violation of payment terms. Providers and customers are expected to engage in good-faith transactions at all times.

Provider Payouts & Payment Processing Fees

Who's Brew uses Stripe to process all customer payments and to disburse funds to Providers via Stripe Connect. By listing products on the platform, Providers agree to the following deductions from each order before payout:

  • Platform commission: A percentage of the discounted product subtotal, as set in the Provider's agreement (default 15%, subject to per-vendor or per-product overrides).
  • Payment processing fee: The Provider's prorated share of the payment processor's per-charge fee (currently 2.9% + $0.30 per order, subject to change based on Stripe's published pricing). The fee is allocated across Providers on a multi-vendor order in proportion to each Provider's share of the order total.
  • Vendor-absorbed discounts: Any bundle discount, wholesale discount, or vendor-issued coupon code applied to the Provider's items.
  • Outstanding platform fees: Any unpaid balances such as bundle participation fees owed to Who's Brew.

Payment processing fees are non-refundable by Stripe. If a Provider issues a refund to a customer, the original processing fee is not returned by Stripe and is not reimbursed by Who's Brew. Providers acknowledge that refund decisions are their sole responsibility and that they may absorb both the refunded amount and the original processing fee.

Customer-facing service or handling fees, shipping charges, and platform-issued promotional discounts are not passed through to Providers and do not affect Provider payouts.

Fraud Prevention

We take fraud prevention seriously. Any attempt to manipulate orders, misuse referral or rewards programs, or engage in deceptive practices may result in account suspension or termination and may be reported to the appropriate authorities.

Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify Who's Brew immediately if you suspect unauthorized access to your account. Who's Brew is not responsible for losses resulting from unauthorized use of your account.
